Terms and conditions
The plain-English terms that apply when you hire us to design, build, host or look after a website.

Who we are
These terms are between you and Amelia Babidge, trading as Fusco Studio (ABN 39 596 248 058), 5 Birchall Rd, Goolwa Beach SA 5214, Australia (“we”, “us”). They apply to every project, product and monthly plan we provide, together with your written quote. If your quote says something different from these terms, the quote wins.
Quotes and scope
- Prices on this website are starting prices. Your final price, scope and timeline are confirmed in a written quote before any work begins.
- The quote lists what’s included (for example the number of pages and features). Anything outside it is extra and charged at the prices on our pricing page or our hourly rate, and we’ll always agree it with you before doing it.
- Quotes are valid for 30 days.
Payment
- Website projects: 50% of the project price is paid before work starts. The remaining 50% is paid before the website goes live.
- One-time services (such as a website refresh or add-ons) are paid as stated in your quote.
- Monthly plans (hosting and website care) are billed monthly in advance.
- Prices are in the currency shown on your quote. Any taxes that apply are shown on your quote and invoice.
- The website is launched on your domain once the final payment is received. If a monthly plan isn’t paid, we may pause the service after giving you notice by email.
Timelines
We’ll agree a target launch date with you. Many projects launch within about 7 days of receiving everything we need, but every timeline depends on the scope and on you sending content, feedback and approvals when needed. Target dates are estimates, not guarantees. If a project is paused on your side for more than 60 days, we may treat it as finished at the stage it reached, or agree a new schedule with you.
Your part
- Send the content we need (text, photos, logos, details) and give feedback and approvals within a reasonable time.
- You confirm you own, or have permission to use, everything you send us, and that it doesn’t break anyone else’s rights or the law.
- You’re responsible for the accuracy of your business information on the website, and for how you run your business and handle your own customers’ data. We don’t give legal, tax or financial advice.
Revisions
Each website project includes one round of revisions on the full preview, unless your quote says otherwise. Extra revision rounds are charged at the price on our pricing page. Changes after launch are covered by a care plan or charged as extra work.
Ownership
- Once the project is paid in full, you own the final design and the content we created specifically for your website, and you can use them for your business.
- We keep ownership of our general tools, code, templates and know-how, and you receive a permanent licence to use them as part of your website.
- Third-party items (such as fonts, stock images or software) stay under their own licences.
- Your domain always stays yours.
- We may show the finished website in our portfolio and on social media. If you’d rather we didn’t, tell us in writing and we’ll respect it.
Hosting and website care
- Monthly plans continue month to month. You can cancel at any time by email with 30 days’ notice.
- We rely on third-party providers (for example our hosting provider). We work to keep your website online and secure, but we can’t guarantee uninterrupted service.
- If you cancel, we’ll help you move your website elsewhere. Any help beyond handing over your files is charged at our hourly rate.
Cancellations and refunds
How cancellations and refunds work is set out in our refund policy, which forms part of these terms.
Liability
Our services come with guarantees that can’t be excluded under the Australian Consumer Law and, where it applies, the consumer law of your country. Nothing in these terms limits those rights. Otherwise, and as far as the law allows:
- our total liability for any claim is limited to supplying the service again or refunding the fees you paid for that service;
- we aren’t liable for indirect losses such as lost profits, lost data or lost business, or for problems caused by third-party services, content you supplied or changes made by others.

Changes to these terms
We may update these terms. The version that applies to your project is the one in force when you accepted your quote.
Law and disputes
These terms are governed by the laws of South Australia, Australia. If something goes wrong, please email hello@fusco-studio.com first and we’ll try to sort it out together. This doesn’t take away any mandatory consumer rights you have where you live.
